This Privacy Policy is subject to and governed by the Goodbye Tension Terms & Conditions. The Services are part of the Platform/Resources and are described further in the Terms & Conditions.

Important: We do NOT retain Personal Information accessed via third party APIs (including Google Workspace APIs) to develop, improve, or train generalized artificial intelligence or machine learning models. Goodbye Tension's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

If you are located in the European Economic Area, United Kingdom, or Switzerland, our legal basis for collecting and using your Personal Information depends on the specific context and type of information:

5.4 Carrier Disclaimer and TCPA Compliance

Carriers are not liable for delayed or undelivered messages. We are not responsible for delivery failures, network outages, or other issues outside our control.

We comply with the Telephone Consumer Protection Act (TCPA) and will only send text messages to phone numbers that have provided express written consent. We do not share your phone number or text message opt-in consent with third parties for their marketing purposes without your separate express consent.

Goodbye Tension complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.

Goodbye Tension has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.

Goodbye Tension has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.

If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. 9.2 DPF Accountability and Enforcement

The Federal Trade Commission has jurisdiction over Goodbye Tension's compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

Goodbye Tension is liable in cases of onward transfers to third parties. We may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under the DPF, you may contact JAMS Mediation, Arbitration, and ADR Services (https://www.jamsadr.com/eu-us-data-privacy-framework) to address complaints and provide appropriate recourse free of charge to you. Under certain conditions, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

9.3 Other Safeguards

When we transfer Personal Information internationally, we ensure appropriate safeguards are in place, which may include Standard Contractual Clauses approved by the European Commission, adequacy decisions, or other legally compliant transfer mechanisms.


10. CHILDREN'S PRIVACY

Our Platform is not intended for children under the age of 16 (or the equivalent minimum age in your jurisdiction, such as 13 in the United States under the Children's Online Privacy Protection Act).

We may collect account login credentials and precise geolocation (if you grant permission). We limit our use of Sensitive Personal Information to purposes authorized by you, required to fulfill your requests, or otherwise permitted by the CCPA.
